1. About Fluentkids

Fluentkids is an educational app designed to help children learn English through playful, age-appropriate learning experiences.

The Service is operated by FLUENT EDUCATION SL, Sants 215, 2-3, 08014 Barcelona, Spain.

2. Eligibility and Children’s Use

Fluentkids is intended for use by children under the supervision of a parent or legal guardian.

By allowing a child to use Fluentkids, the parent or legal guardian agrees to supervise the child’s use of the Service, ensure use complies with applicable laws, and accept responsibility for account or subscription activity.

3. Accounts and Parent Responsibility

Some features may require creating an account or subscribing to a paid plan. You agree to provide accurate information, keep credentials secure, and notify us promptly of unauthorized access.

Parents and guardians remain responsible for all activity conducted through their account and for any child profiles connected to the account.

4. Subscriptions, Free Trials, Billing, and Cancellation

4.1 Paid Subscriptions

Fluentkids may offer monthly, annual, promotional, or other subscription plans. Features, prices, and availability may vary depending on country, platform, or promotional campaign.

4.2 Free Trials

Eligible users may receive a free trial. Unless cancelled before the trial ends, the subscription may automatically convert into a paid subscription using the pricing and billing period displayed at purchase.

4.3 Automatic Renewal

Subscriptions automatically renew unless cancelled before the renewal date through the relevant platform account settings. The payment method associated with your Apple ID or payment provider may be charged automatically upon renewal.

4.4 Cancellation

Subscriptions can be managed and cancelled through your device account settings or the platform used to purchase the subscription. Deleting the app does not automatically cancel a subscription.

4.5 Refunds

Refunds are generally handled by the platform through which the purchase was made. For Apple App Store purchases, refund requests are subject to Apple’s policies and procedures.

5. Apple App Store Terms

If you download Fluentkids through the Apple App Store, these Terms are concluded between you and FLUENT EDUCATION SL, not Apple. Apple is not responsible for the Service, maintenance, support, or claims related to the Service.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app must comply with applicable Apple App Store terms.

6. Educational Content and Learning Progress

Fluentkids is designed as a supplementary educational tool. We do not guarantee language fluency, educational outcomes, academic performance, vocabulary acquisition targets, or school results.

Progress systems, rewards, levels, achievements, stickers, and similar features are intended for motivation and engagement purposes only.

7. Acceptable Use

You agree not to:

• use the Service unlawfully or fraudulently;
• interfere with or disrupt the Service or servers;
• attempt to reverse engineer, copy, scrape, or exploit the Service;
• misuse the Service in a manner that could harm children, users, or third parties;
• reproduce or commercially exploit Fluentkids content without authorization.

8. Privacy and Children’s Data

Protecting children’s privacy is extremely important to us. Our collection and use of personal data are governed by our Privacy Policy:

Fluentkids is designed with child privacy and safety considerations in mind, including compliance efforts relating to COPPA, GDPR and GDPR-K, and Apple Kids Category requirements.

9. Intellectual Property

All content and materials included in Fluentkids, including software, illustrations, animations, characters, educational activities, logos, trademarks, audio, graphics, designs, text, and visual assets, are owned by or licensed to FLUENT EDUCATION SL and are protected by intellectual property laws.

You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial household use. No ownership rights are transferred to you.

10. Service Availability and Changes

We may modify, update, suspend, discontinue, or remove portions of the Service at any time, including educational content, subscription plans, features, rewards systems, pricing, and app functionality.

We do not guarantee uninterrupted or error-free availability.

11. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided on an “AS IS” and “AS AVAILABLE” basis.

We disclaim all warranties, express or implied, including warranties relating to merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, accuracy, or reliability.

Nothing in these Terms limits rights granted under mandatory consumer protection laws.

12. Limitation of Liability

To the maximum extent permitted by law, FLUENT EDUCATION SL and its affiliates, employees, licensors, partners, and service providers shall not be liable for indirect, incidental, consequential, or similar damages.

Our total aggregate liability arising out of or relating to the Service shall not exceed the total amount paid by you to Fluentkids during the twelve (12) months preceding the claim.

13. Suspension and Termination

We may suspend or terminate access to the Service if these Terms are violated, unlawful or abusive activity is detected, or continued access could create security, legal, or operational risks.

You may stop using the Service at any time. Subscription cancellations must be performed through the relevant app store or payment provider.

14. Changes to These Terms

We may update these Terms periodically. When material changes are made, we may update the “Last updated” date, provide website notice, or provide in-app notifications where appropriate.

Continued use of Fluentkids after updated Terms become effective constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Spain, without prejudice to mandatory consumer rights applicable in your country of residence.

Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the competent courts under applicable consumer protection law.
